There's a growing recognition of a gap in the family leave laws of many states for those that suffer pregnancy loss. As Nikki Battiste reports, some lawmakers and advocates are pushing for more protections for grieving families.

A CBS America report reveals that family leave laws in many U.S. states do not provide paid leave for parents experiencing pregnancy loss. The story features Jackie Mancinelli from New Jersey, who was ineligible for paid family leave after her infant son died shortly after birth, and discusses the emotional and physical toll such losses can take.

As of 2023, only five states require employers to offer any form of bereavement leave. Pennsylvania State Senator Amanda Capaletti, who has experienced multiple miscarriages, has introduced legislation to provide three days of paid leave for pregnancy loss or failed adoption. Advocates like the Mancinelli family are working to reduce stigma and improve workplace rights for grieving parents.

And CBS's Nikki Batiste has the story from Turnersville, New Jersey. Jackie Mancinelli's baby, Richard, is one of nearly 300 honored at this New Jersey hospital's infant memorial. Richard died an hour after birth from a rare complication several years ago. I asked if I wanted to hold him and he looked a lot like his dad. It was hard to believe that he was gone. The Mancinelli's grief and physical recovery after Richard's death was overwhelming. Jackie, a teacher, used all her sick days, but she needed far more time as she tried to heal. In New Jersey, I no longer qualified for the paid family leave since Richard had died. Because he died? Yes. I couldn't believe it. I had, you know, I gave birth. As of 2023, five states require employers to provide any bereavement leave, paid or unpaid. As many of you know, I am one of those who has experienced a miscarriage. Pennsylvania State Senator Amanda Capaletti, who's had three miscarriages, proposed change. More than one million pregnancies end in miscarriage or stillbirth every year. Capaletti, who's pregnant with her second daughter, introduced a bill that would provide Pennsylvanians three days of paid time off after pregnancy loss and failed fertility or adoption. We want to be able to give people a couple of days and feel like they're in a better spot to return to the workplace. And to be paid. Absolutely. That provides dignity. The Mancinelli's now have two daughters and launched the non-profit Start Healing Together, which helps people advocate for workplace rights after these types of loss. Why do you think there isn't better coverage for these sorts of losses? I think in our society, we treat these losses as highly stigmatized. I think a lot of us feel like, you know, this is just the way it is. But when you stop, you're like, I deserve more. I deserve more than this.
