Former New York Governor and current mayoral candidate Andrew Cuomo is the subject of a criminal investigation by the US Department of Justice (DOJ). The probe concerns allegations that Cuomo lied to Congress about COVID-19-related nursing home deaths during his tenure as governor. The investigation is linked to an executive order issued by Cuomo that required nursing homes to accept patients who had tested positive for COVID-19. This order was later reversed, but not before changes in the reporting of nursing home deaths drew scrutiny.

Cuomo has denied involvement in drafting or reviewing an official state health department report that attributed COVID-19 spread in nursing homes to staff and visitors rather than the executive order. However, the House Oversight Committee released evidence contradicting his testimony and has referred Cuomo for prosecution, alleging he lied under oath. House Democrats also released a report accusing Cuomo of undercounting nursing home deaths.

In response, several Democratic lawmakers, including Congressmen Jerry Nadler and Richie Torres, have characterized the DOJ investigation as election interference. Cuomo’s campaign has echoed this sentiment, suggesting the investigation is politically motivated and pointing to similar claims of "lawfare" previously raised by political figures. A spokesperson for Cuomo stated that they had not been informed of the investigation and questioned the timing of the information leak.
