A federal judge is considering whether detainees at a temporary immigrant detention center in the Florida Everglades have been denied their legal rights.

Attorneys representing detainees at this facility claim that their clients' constitutional rights are being violated due to the lack of confidential in-person legal consultations and the absence of an on-site immigration court. The state of Florida maintains that the facility operates under different standards than federal centers, which typically include immigration courts.

In addition to legal concerns, a separate lawsuit has been filed by a Native American tribe and environmental groups, alleging that the facility endangers the Florida Everglades and circumvents required federal environmental reviews. The administration is also considering expanding similar state-run or repurposed facilities, including military bases, to accommodate the growing number of detainees.

What detainees say about legal rights inside "Alligator Alcatraz"

The U.S. Immigration and Customs Enforcement Agency is ramping up its recruitment to expand its immigration crackdown. The agency is even offering $50,000 signing bonuses. A surge in arrests means an increase in detention facilities. One Florida site, known as Alligator Alcatraz, was at the center of a federal hearing today focused on detainees due process. CBS' immigration reporter Camilo Montoya-Galvez joins me now, as he always does. Camilo, tell me about what the lawyers are saying for these detainees. Well, John, the attorneys are saying that the constitutional rights of the immigrant detainees held at Alligator Alcatraz in Florida are being trampled on. And they say that these detainees who are facing deportation from the U.S. are not getting access to confidential in-person legal consultation periods with lawyers. And they say that they are only getting remote access to these attorneys that is not confidential. They say that violates their rights legally. We know that the state of Florida has said that this is a state-run facility that doesn't have the same standards or rules as federal facilities, many of which have immigration courthouses inside of them. This facility does not. And so there is no immigration court at Alligator Alcatraz to actually adjudicate and hear the claims of people who are seeking to fight their deportation. This lawsuit also seeks to have the administration designate an immigration court for these detainees, John. It's not the only lawsuit related to this facility, right? No, it is not. There is another separate lawsuit also in Florida that centers on environmental concerns. A Native American tribe, John, and a group of environmental groups say that this facility is endangering the Florida Everglades and the wildlife there, and also circumventing federal laws that actually require environmental reviews before any major construction project. The state of Florida says that federal environmental reviews do not apply in this case because This is not a federally run facility, but instead one overseen by the state. Are there other facilities that are going to be built that are basically like this one? Yes. The administration says that it will look to states like Nebraska and other Republican-led jurisdictions to lend them facilities, to turn them into immigration detention centers. Importantly, the administration is also trying to turn military bases into immigration detention centers. Just this past weekend, Fort Bliss in Texas, that army base started housing immigrant detainees. It currently can hold 1,000 detainees, but there are plans to have as many as 5,000 detainees there. That would be the largest immigration detention facility in American history.
