On Friday, the Alabama court applied that to all unborn children without limitation, including frozen embryos stored in a cryogenic facility. The ruling stems from a lawsuit filed against an IVF clinic, after three frozen embryos were dropped on the floor and destroyed in an accident. Medical associations now warn that the increased risk of legal exposure could result in Alabama's fertility clinics shutting down, or at best, push up the already prohibitive costs of IVF, a process where human eggs are fertilized outside of the womb and later implanted in a human uterus. Alabama's Supreme Court ruling is a terrifying development for the one in six people impacted by infertility, who need in vitro fertilization to build their families. This new legal framework may make it impossible to offer services like IVF. IVF advocates had warned that such decisions were a potential repercussion of the US Supreme Court's 2022 decision to overturn the constitutional right to an abortion. An opinion echoed by the White House, which called the ruling exactly the type of chaos expected when the Supreme Court overturned Roe v. Wade, and paved the way for politicians to dictate some of the most personal decisions families can make. Alabama is one of some two dozen US states that has banned or restricted access to abortion.
