The H-1B visa program, established in 1990, allows U.S. companies to employ foreign workers in positions that require at least a bachelor's degree, with the technology sector being a significant user of the program.

The new fee applies only to future H-1B applicants and does not impact current visa holders or those who submitted applications before the order took effect. The Department of Homeland Security clarified the scope of the policy following initial confusion among companies and workers.
